1. License

1.1 The Commonwealth of Australia, represented by the Department of Defence (the ‘Licensor’) hereby grants to you a non-exclusive licence to read and download any or all files or documents (‘Products’) accessible in your account on the following terms.

1.2 This licence does not transfer any ownership rights in the Products. All intellectual property rights (including copyright) in the Products and the accompanying documentation remain with the Licensor, or for third party products, the original publisher.

1.3 This Licence permits you to use the Products on Department of Defence owned equipment which is under your personal control.

1.4 You shall not:

1.4.1 use or copy the Products other than is permitted by this Licence;

1.4.2 allow others to access your account nor attempt to access any account not allocated to you;

1.4.3 distribute downloaded Products by any means to parties outside of the Department of Defence, unless prior written approval is granted by CO AIS-AF.

1.4.4 modify, adapt, merge, translate, decompile, disassemble, or reverse engineer the Products; and;

1.4.5 use, sell, assign, rent, sub-licence, loan, mortgage, charge or otherwise deal in any way in the Products or its accompanying documentation or any interest in them or under this Licence except as expressly provided in this Licence.

 

2. Term

2.1 Subject to clause 2.2, this Licence shall last for as long as you continue to subscribe to the web service.

2.2 This Licence shall terminate automatically if you breach any of these Terms and Conditions.

 

3. Warranties & remedies

3.1 The Licensor warrants that to the best of its knowledge, the Products will be supplied free from defects in materials and workmanship under normal use for the period of the Products’ validity after the date of the original download. If a defect in any Products is observed during this period you may inform the Licensor who will correct it.

3.2 The warranties set out in clauses 3.1 are your sole warranties and are in place of all warranties, conditions or other terms expressed or implied by statute or otherwise, all of which are hereby excluded to the fullest extent permitted by law. Clause 3.1 is the sole remedy for any breach of the Licensor’s warranty.

3.3 In particular the Licensor does not warrant that the Products will meet your requirements, be error-free, or that all errors in the Products can be corrected. You use the Products at your risk, and in no event will the Licensor be liable to you for any loss or damage of any kind (except personal injury or death resulting from the Licensor’s gross negligence), including lost profits or other consequential loss arising from the use of the Products or from errors or deficiencies in it whether caused by negligence or otherwise, except as expressly provided in this Licence.

 

4. Law

4.1 This Licence, which constitutes the entire agreement between you and the Licensor relating to the Products, is governed by the law of the Australian Capital Territory (‘ACT’) and the exclusive jurisdiction of the ACT courts.
